THE APPLICANT REQUESTS THAT:
He be awarded points for the period Jul 92 through Apr 95 and
that each year be credited as a year of satisfactory service
towards retirement.

THE APPLICANT CONTENDS THAT:
He was not credited with good years for the entire time he
served as an Air Reserve Technician (ART).
In 2012, he realized that he was not credited with any
retirement points during this period and has been trying to
resolve this issue ever since.

STATEMENT OF FACTS:
Based on the Point Credit Accounting and Reporting System
(PCARS), after a civilian break of almost seven years, on 24 Sep
92, the applicant returned to the Air Force Reserve. He was
credited with a satisfactory year of service for his Retirement
Year Ending 23 Sep 93.
According to Reserve Order (RO) A-079, on 23 Nov 93, he was
assigned to the Non-obligated Non-participating Ready Personnel
Section (NNRPS). The assignment action reason on the order
indicated the applicant had a job/school conflict.
On 2 Sep 96, he was released from the NNRPS and assigned to the
security police squadron at Westover AFB MA.

THE AIR FORCE EVALUATION:
ARPC/DPTS recommends denial stating, in part, that the
applicant's account of service dates and times do not coincide
with the documentation in his military service history on file.
He does not have any Leave and Earnings Statement (LES) because
none exist. He was not in a point gaining activity nor was he
able to earn retirement points during the three years he was
assigned to the NNRPS. Therefore, he could not earn
satisfactory Federal service years. Moreover, his request for
satisfactory service years while assigned to NNRPS is not in
compliance with the applicable law. The applicant received a
satisfactory retirement year ending 23 Sep 93.

APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 5 Aug 13 for review and comment within 30 days. As
of this date, no response has been received by this office
(Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we agree with the opinion and recommendation
of the Air Force office of primary responsibility and adopt its
rationale as the basis for our conclusion that the applicant has
not been the victim of an error or injustice. Therefore, in the
absence of evidence to the contrary, we find no basis to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
with this application.

He was awarded several ribbons/devices for his time on active duty and in the Air Force Reserves. He later received a call from ARPC and they informed him that they would not be able to award him point credit because he was assigned to the IRR Non-participating Ready Personnel Section. He is currently pursuing another reserve job to complete his military retirement. He completed SOS on 3 Jan 2002.
